Dr. Conrad Murray Requesting Dismissal Of Wrongful Death Lawsuit



Dr. Conrad Murray is asking a judge to throw out the wrongful death lawsuit that Michael Jackson's father, Joe filed against the King of Pop's one time physician, Radaronline.com can exclusively report.

Lawyers for Dr. Murray filed the legal docs last Friday, arguing that Joe Jackson doesn't have legal standing to even file the lawsuit -- Michael left his father, Joe out of his will and did not support him financially.

The legal docs state: "Joe Jackson further has no standing to sue pursuant to...in that he was not dependent upon the decedent for support and therefore Joe Jackson has no subject matter jurisdiction, alternatively, in personam jurisdiction to sue....Defendants request that the Plaintiff's case be dismissed, alternatively, that the Plaintiff go forth without recovery from these Defendants."

Michael Jackson died on June 25, 2009, from acute propofol intoxication. Dr. Murray's trial for involuntary manslaughter, is expected to begin in August. If convicted of the charge, Murray could be sent to state prison for up to four years.[/color]

TGli avvocati del Dr. Murray hanno presentato la documentazione legale venerdì scorso, sostenendo che Joe Jackson non ha legittimazione neanche a presentare la causa dato che Michael ha lasciato suo padre, Joe, fuori dal testamento e non lo sosteneva finanziariamente.
Il documento dichiara: "Joe Jackson inoltre non è legittimato a citare in giudizio ai sensi... in quanto non era dipendente economicamente dal defunto e quindi Joe Jackson non ha alcuna giurisdizione nel citare in giudizio .... gli imputati richiedono che il caso del querelante sia essere respinto, o in alternativa, che il querelante vada avanti senza risarcimento da parte di questi imputati ".

Michael Jackson è morto il 25 giugno 2009, da intossicazione acuta da Propofol. Il processo al dottor Murray per omicidio colposo, dovrebbe iniziare nel mese di agosto. In caso di condanna, Murray potrebbe finire in galera fino a quattro anni.

Joe Jackson Wrongful Death Lawsuit Tossed Out of Court



Joe Jackson screwed up by filing a Michael Jackson wrongful death lawsuit against AEG and Dr. Conrad Murray ... a judge has just ruled.

Joe filed his wrongful death lawsuit AFTER Katherine Jackson filed hers -- on her own behalf and on behalf of the kids.

It's unclear why Joe didn't try to join in Katherine's suit rather than filing a separate one on his own. It's possible Katherine didn't want him.

Whatever the reason, the judge said you can't have 2 suits that allege the exact same thing, and since Katherine filed first Joe loses.

Joe could now try to horn in on Katherine's legal action -- if she'll let him.

Joe Jackson Causa civile contro l'AEG respinta

La querela presentata da Joe Jackson contro l'AEG e il Dr. Conrad Murray per omissione di soccorso nei confronti di Michael Jackson è stata respinta, secondo un giudice che lo ha appena stabilito.

Joe ha presentato la sua querela per omissione di soccorso dopo quella di Katherine Jackson a suo nome e per conto dei figli di MJ.

Non è chiaro perché Joe non ha cercato di unirsi nella causa di Katherine, piuttosto che presentarsi in una separata per conto suo. E 'possibile che Katherine non lo voleva.

Qualunque sia la ragione, il giudice ha detto che non è possibile avere 2 cause che pretendono la stessa identica cosa, e dato che Katherine ha presentato la causa per prima, quella di Joe è stata annullata.

Joe potrebbe comunque tentare di unirsi alle azioni legali di Katherine - se lei darà il suo permesso.
