ESECUTORI RISOLVONO CON HEAL THE WORLD!!

Michael Jackson Estate Settles with Heal the World
The Michael Jackson Estate has settled its lawsuit against the Heal the World Foundation, and the Estate is now copacetic with the charity using Michael Jackson's name.
The Estate had sued Heal the World, on grounds it had no right to use MJ's name to solicit money. But we've learned there was a secret meeting yesterday between Katherine Jackson's new lawyer, Perry Sanders, and Estate lawyer Howard Weitzman.
The attorneys settled the beef, so Heal the World can now use Michael's name and likeness, and Katherine will sit on the Board of Directors of the charity.
The lawyers are going to court this AM to dismiss the lawsuit.

Gli esecutori di Michael Jackson hanno risolto la loro causa contro Heal The World Foundation, e la Tenuta è ora soddisfatto ad usare il nome di Michael Jackson per beneficienza.
La tenuta aveva citato in giudizio Heal the World,in quanto non aveva alcun diritto di usare il nome di MJ per chiedere denaro. Ma abbiamo saputo che c'è stato un incontro segreto ieri tra il nuovo avvocato di Katherine Jackson, Perry Sanders, e l'avvocato degli esecutori, Howard Weitzman.
Gli avvocati hanno stabilito che Heal the World ora ha il permesso di utilizzare il nome di Michael e cose inerenti, e Katherine siederà nel Consiglio di Amministrazione della fondazione.
Gli avvocati sono andati questa mattina in tribunale per chiudere la causa legale.

Press reports on TMZ and other media sites regarding the settlement terms between the Michael Jackson Estate and the Heal the World defendants are wrong. The Estate is taking back the Heal the World Foundation and all of the Michael Jackson trademarks it allegedly owned. The Michael Jackson Estate owns the Heal the World name, and neither Melissa Johnson nor her companies will ever be able to use Michael Jackson’s name or the Heal the World name.
This is all we have for now… not much a statement right?

Le notizie riportate da TMZ e altri siti di media per quanto riguarda i termini dell'intesa tra la la Michael Jackson Estate e la convenuta Heal the World sono sbagliate. L'Estate si riprenderà la Heal il World Foundation e tutti i marchi di Michael Jackson che secondo loro possiedono. La Michael Jackson Estate possiede il nome Heal the World, e né Melissa Johnson né le sue società potranno mai utilizzare il nome di Michael Jackson o il nome Heal the World.
Questo è tutto quello che abbiamo per ora ... non tanto un diritto di affermazione?

Heal the World Reject Estate Settlement
Last month the Estate settled its lawsuit against the Heal the World Foundation, and made it clear they were more than happy with the charity using Michael Jackson’s name. However, court documents obtained by MJNA show things seem to have turned rather sour.
In court documents filed over the weekend… Nina D. Boyajian –an associate of Greenberg Traurig(the guys representing Branca and McClain) say Mellisa Johnson — on behalf of HTW… is refusing to sign documents required to finalise the settlement.
Just days after the public announcement confirming both parties had settled, HTW lawyer Edgar Pease contacted Boyajian stating that he has “concerns” with some of the documents drafted by the Estate. In addition, Pease copied the “concerns’ to Howard Mann violating their confidentiality agreement.
Mel Wilson, officer of HTW, sent a letter to the Estate stating that they rescind and reject the settlement agreement. Wilson states that the reason is because Melissa Johnson did not have the authority to sign for HTW and that the Board of Directors did not have enough time to approve the agreement.
The Estate of Michael Jackson will file court documents May 19 to enforce the settlement agreement that Melissa Johnson signed on behalf of HTW.

Il mese scorso la tenuta cha portato avanti e risolto la sua causa contro la Heal the World Foundation, e ha precisato che sono stati più che soddisfatti delle opere di carità, utilizzando il nome di Michael Jackson. Tuttavia, i documenti ottenuti dal tribunale mostrano che MJNA sembra aver girato una soluzione piuttosto inaccettabile.
Nei documenti della corte presenti durante il fine settimana ... Nina D. Boyajian-socio di Greenberg Traurig (i ragazzi che rappresentano Branca e McClain) dicono che Mellisa Johnson - per conto di HTW ... si rifiuta di firmare i documenti necessari per perfezionare l'insediamento.
Pochi giorni dopo l'annuncio pubblico che conferma che le due parti avevano trovato un accordo, l'avvocato HTW Edgar ha contattato Boyajian ed ha dichiarato che è "preoccupato" per alcuni dei documenti elaborati dalla Estate. Inoltre, Edgar ha riposrtato le stesse preoccupazioni 'per Howard Mann,nella violazione del loro accordo di riservatezza.
Mel Wilson, agente di HTW, ha inviato una lettera alla Estate affermando che rescinderono e respingono l'accordo transattivo. Wilson afferma che il motivo è legato al fatto che Melissa Johnson non aveva l'autorità di firmare per HTW e che il Consiglio di Amministrazione non ha avuto abbastanza tempo per approvare l'accordo.
La tenuta di Michael Jackson ha depositato i documenti del tribunale il 19 maggio per far rispettare l'accordo di liquidazione che Melissa Johnson ha firmato a nome della HTW.

Il nuovo avvocato di Melissa Johnson dichiara che l'Estate di MJ ha tentato d'influenzare il precedente legale con un compenso monetario. Inoltre aggiunge che la sua assistita assumerà altri avvocati esperti in cause giuridiche relative a proprietà intellettuale.

Melissa Johnson ha chiesto un'udienza per il 24 Ottobre, ha cambiato nuovamente avvocato ed ha richiesto un ulteriore rinvio del caso.
