It's Closing Argument Time!


It's now or never ... bottom of the 9th ... both sides in the Conrad Murray manslaughter trial have one last shot to sway the jury ... when closing arguments begin this morning.

After that, the judge will give final instructions to the jury ... and then it's off to the races!!

Some experts believe there's a good chance they could return a verdict before the weekend.

Prosecutor David Walgren just began his closing arguments to the jury, insisting Dr. Conrad Murray caused the death of Michael Jackson.

* Walgren told the jurors that for Prince, Paris and Blanket this trial will not end today because they lost their father.
* He said Conrad Murray violated the sacred trust between doctor and patient "each and every day."
* This relationship of trust that is so important was grossly corrupted by the actions of Conrad Murray.
* We know that on June 24th MJ performed at the Staple Center and gave a great performance. We know that 12 hours later he was laying dead in his bed in his home.
* MJ was excited. He was looking to the future.
* MJ was a creative genius striving for perfection. He wanted to be the best.
* MJ was making long term plans for both himself and his children. He was excited to settle down.
* He wanted to thank his fans for their years of loyalty.
* MJ also wanted to do it for his children. He wanted them to see him be creative. That was one of the foundations for his desire to go on tour.
* He wanted a large estate for streams and horses and animals so that his kids could live a normal life.
* We heard about his desire to open a children's hospital ... to give this to the world. Michael had plans and hopes and dreams.
* What we also know from multiple witnesses that what was paramount to him was his children. He was excited his kids would get to see their dad perform in London. But none of this came to be because on June 25, 2009 MJ was pronounce dead at age 50.
* we will discuss how Paris saw her dad on that day and cried "daddy!"
* we will discuss how Prince had a shocked reaction. That's what Murray did.
* Joe, Katherine, La Toya and Randy Jackson are in court.
* Walgren reminds them they each swore to follow the law. He tells them they need to fulfill their obligation as jurors.
* As a doctor the law recognized this special relationship and the law states that you have a legal duty to act.
* The failure to act on that duty caused the death of Michael Jackson.
* Criminal negligence is not about having an intent to cause harm.
* Defendant remains criminally negligent if he could have foreseen the death.
* Conrad Murray knew MJ liked to push his own Propofol. Conrad Murray should have known not to leave MJ alone in a room full of drugs.
* Dr. Murray made false leading statements when he failed to tell doctors he administered Propofol. It proves he knew what he did was wrong. He never once mentioned it to paramedics or doctors at UCLA. These were false statement. That is consciousness of gu
*June 24, Mj's last rehearsal was again a success. Everyone was excited that the tour was going to finally happen. MJ was particularly excited about the "illusion" that was to be performed the next day."
* He told Ortega, "I Love you." and they hugged.
* Randy Phillips also hugged MJ.
* After MJ's death an arrangement was made to meet with Conrad Murray at Marina Del Ray. Conrad Murray was there with his lawyers. At this point, investigators knew very little. The cause of the death had not yet been determined. Detectives were working in the dark. They sat down to listen to Conrad Murray to listen to what he had to say. The recorded what Murray had to say.
* What we learned is that he was MJ's doctors and that his purpose was to put MJ to sleep.
* When detectives ask how frequently did this happen? Murray tells them every day.
* He describes how he gave 50 mg injections follwed by a drip every day ... except for a couple of nights before.
* According to Murray the only time MJ slept was right before 4:00 am.
* At 4:00 am Murray tells investigators, "MJ was complaining he couldn't sleep."
* At 5:00 he gives MJ Lorazepam and then at 7:30 Midazolam.
* At 10:00 am Jackson requests Propofol.
* Walgren says Murray tells cops he was worried giving MJ Propofol at 10:00 because MJ had to be up at noon -- 2 hours later -- suggesting he intended to knock him out... not put him to sleep for only 5 minutes.
* After going to the bathroom, Murray sees that MJ is not breathing. He does not call 911 becasue to speak to a 911 operator would be to neglect MJ.
* What does he do? He calls Michael Amir Williams and left a message. Setting aside all the other bizarre behavior, all he needed to say was, "Call 911." But he doesn't.
* He left a voice mail message instead of using that time to call 911 ... because he was putting Conrad Murray first. Maybe he need to hide the evidence.
* We also heard about Murray's phone conversation. One conversation was 23 minutes long. does it make sense that MJ can't sleep and Conrad is on the phone? Or is it more probable MJ was ona drip.
* We know he was looking at emails. Long emails. We have the screen grabs. We also know he sent a response at 11:17 am.
* We know Sade heard voices in the background at the exact time Murray drops the phone. Was Conrad Murray in another room? Did MJ call fro help? Did he gasp? Did he choke? We don't know... we'll never know. Because of Murray's neglect.
* You've heard the message he left to MJ's assistant, Michael Amir Willaims.
* Williams calls Faheem Mohammed and Alberto Alvarez.
* As Alvarez walks into the bedroom he hears Paris screaming, "Daddy!" and ushers the kids out of the room.
* Murray grabs vials of medicine and instructed Alvarez to put it in a bag. He then asks to grab a specific saline bag, not both of them.
* Only then does Murray asks Alvarez to call 911. Not when he called Amir Williams, not when when he Alvarez first came into the room.... but after hiding the evidence. 20 minutes later.
* Paramedics respond in 6 minutes. They were a mile and a half away.
* Paramedics talked about the basic life support he did right away ... unfortunately it was too late.
* EMT had equipment that could have saved MJ's life had Murray called them immediately.
* As paramedics take MJ to the ambulance, Murray is picking stuff off the floor and putting it in a trash bag. Why?
* In the hospital doctors ask Murray what drugs he had given MJ ... again Murray never mentions Propofol.
* After MJ was pronounced dead, Murray is concerned about retrieving a "cream" MJ didn't want people to know about. Murray was not concerned about a cream... he was worried about himself.
* Murray went into the interview because he assumed police had found his bags in MJ's room. He knew the toxicology report was going to come out. He went in there to do damage control. He came forward for the self preservation of Conrad Murray. He came forward to get ahead of the story. Unfortunately his story doesn't match up with the evidence.
* Every single doctor has told you they would never have done what Murray did.
* We learned Propofol is used in a highly monitored setting. This is basic common sense. No one had ever heard of anyone using Propofol in a bedroom... EVER ... until Murray did it. it's an egregious violation of medical care. It's gross criminal negligence.
* Murray conducted an experiment on MJ.
* Propofol is a wonderful drug ... if used appropriately. It requires immediate access to standard resuscitation equipment. You also need to know how to use it. Murray went straight to compressions and mouth to mouth, never using the ambu bag he had.
* Preoccupation with emails, texts and calls are an abandonment of a patient. Leaving the patient's side is even worse.
* Benzodiazepines are unpredictable. Giving MJ those powerful sedatives in an unmonitored setting was criminally negligent.
* Murrray Failed to document ... not a single vital sign was recorded, not a single dose written down. Murray was all too happy to record MJ's voice, but didn't bother taking any notes. Murray chose not to have any medical records because he didn't want his bizarre treatment to be documented.
* He deceived doctors at UCLA Medical Center, an extreme deviation of standard of care.
* Expert now have to speculate what happened to MJ... all because Murray didn't take notes.
* Dr. Steven Shafer said the most likely scenario is that Murray gave Jackson a drip. It's based on the evidence... a cut saline bag with Conrad Murray's finger prints on it found at the scene.
* The hanging tab on the Propofol bottle was unused and intact... suggesting the bottle was hanging in the saline bag.
* Murray admitted he did that every night, a 50 mg injection followed by a drip.
* MJ wasn't complaining he couldn't fall asleep .. he WAS asleep... because Conrad Murray put him on a drip.
* We'll never know what really happened. What we do know is that MJ died of Propofol intoxication as a direct result of Murray's actions.
* Murray's former patients say he was a good doctor ... but they were all treated in a hospital for things Murray was trained to do.
* The defense called Dr. Allan Metzger who told us there is no amount of money he would take to give Propofol in a bedroom.
* MJ was not reckless. He had a life ahead of him. He had 3 children he loved dearly. He had the means to get Propofol himself but he didn't do that. He wanted a doctor monitoring him at all time.
* Murray should have kept the drugs under lock and key.
* What defense expert Dr. Paul White presented was junk science. It was disappointing. It was sad for science and for truth seeking.
* Walgren suggested perhaps Dr. White needed the money since he's retired.
* He never studied anything. He had defense attorney Michael Flanagan call a researcher in Indiana to conduct a study for him.
* MJ trusted Conrad Murray. He trusted him with his life. He paid with his life. Conrad Murray lied, deceived, obscured. More importantly, he acted with negligence, he looked out for himself. That's not what a doctor does. Conrad Murray's action caused MJ's death. But the people do not need to prove that because even if defense's facts are true ... Murray should still be held responsible.
* Walgren asked the jury to find Murray guilty of manslaughter because he abandoned his patient. "Justice demands a guilty verdict," he concluded.

Ma niente di tutto questo è venuto per essere, perché il 25 giugno 2009 MJ è stato pronunciato morto all'età di 50 anni.

* I paramedici parlano del supporto vitale di base che ha fatto subito ... purtroppo era troppo tardi.
* EMT aveva apparecchiature che avrebbero potuto salvare la vita di MJ sse Murray li avesse chiamati subito.
* Come paramedici prendono MJ per l'ambulanza, Murray ha raccogliere la roba da terra e l'ha messa in un sacco della spazzatura. Perché?
* In ospedale i medici chiedono a Murray quali farmaci aveva dato ad MJ ... ancora mai Murray cita Propofol.
* Dopo che MJ è stato dichiarato morto, Murray si preoccupa di recuperare una "crema" che MJ non voleva che la gente potesse conoscere. Murray non era preoccupato per una crema ... era preoccupato di se stesso.
* Murray entrò nella intervista, perché assunse che la polizia aveva trovato le valigie in camera di MJ. Sapeva che il rapporto tossicologico sarebbe venuto fuori. È andato lì per fare controllare i danni. Si fece avanti per la conservazione di auto di Conrad Murray. Venne l'ora di andare avanti della storia. Purtroppo la sua storia non corrisponde con l'evidenza.
* Ogni singolo medico ti ha detto che non avrebbe mai fatto quello che Murray ha fatto.

Ed Cherfnoff -- Defense Attorney's Closing Arguments



Defense Attorney Ed Chernoff just began his closing arguments to the jury.

Chernoff said the prosecution failed to prove a crime was committed.

* Murray made mistakes. But this is not a civil case. For a crime to be committed, the prosecution has to show Murray killed MJ.
* Chernoff tried to discredit Alberto Alvarez testimony. He said it didn't make sense that Murray would ask him hide evidence when they barely knew each other.
* Alvarez testified he grabbed the IV bag with both his hands ... but none of his fingerprints were found on the bag.
* Alvarez also said he noticed a milky substance in the IV bag, but no traces of Propofol were found inside the bag.
* There are no photos showing a vial inside an IV bag. The coroner investigator testified she took the vial out of the bag BEFORE taking a picture.
* LAPD detective Scott Smith also testified he never saw a vial in a bag.

* Murray didn't need to create an elaborate IV set up -- placing a vial inside an empty bag -- when he could have just used the hanging tab on the bottle.
* The tubing found in MJ's bedroom did not have any Propofol in it.
* Shafer is not an investigator he is a computer analysts working for the prosecution.
* Good scientists don't take positions. Shafer had an agenda. He was trying to make a point. Dr. White knows more about Propofol than Dr. Shafer will ever know. White told the truth.
* Shafer's simulations had nothing to do with the case. Why would he do that? Because when you go backwards trying to figure out what happened... there are a million possibilities. But Shafer demonstrated what happened as if he were a cop.
* Even though there was Lorazepam found in MJ's stomach, Shafer never explained how it got there because it didn't fit his theory.
* There are 2 reasonable scenarios for what happened and if that's the case, the jury should acquit.
* Chernoff asked the jury, "If it were anyone else other than Michael Jackson, Would the doctor be here today?"
* Chernoff told the jury in order to convict they have to believe Murray had disregard for human life ... he reminded them all of Murray's patients testified he was a caring doctor.
* The prosecution argued the reason the IV tubing was not found at the scene was because Murray bundled it up and stuck it in the pocket of his baggy cargo pants. But Chernoff argued he could have taken anything, why would he choose the tubing?
* Murray's biggest personality defect is his greatest strength. He thought he could help MJ. He was wrong. "He was a little fish in a big dirty pond," he said.
* Murray didn't call 911 because he was busy trying to save MJ's life. He immediately tried CPR ... when that didn't work he injected him with Flumazenil. He then asked MJ's chef to call for help.
* The 911 call was 163 seconds. Had Murray used that time to call 911 instead of reviving MJ, the prosecution would have argued THAT was a deviation of the standard of care.
* The prosecution says everything Murray did was a deviation from the standard of care because they're out to get Murray.
* There is a tremendous desire to paint Murray as a villain. There is no perfect villain or perfect victim.
