Judge rules Michael Jackson's business manager must testify


Los Angeles (CNN) -- Michael Jackson's former business manager, Tohme Tohme, must testify in the trial of Dr. Conrad Murray, who is accused in Jackson's death, a judge ruled Monday.

Tohme's lawyers argued that their client was not properly served the subpoena, but a process server testified she handed it to Tohme at his home on March 3. A used car dealer testified Monday that he was with Tohme at an auto auction at the time.

"I am satisfied there was service in this case," said Los Angeles Superior Court Judge Michael Pastor, after hearing both witnesses.

Pastor was more concerned about the argument that Tohme's testimony would be irrelevant to the Murray case.

Paul Takakjian, Tohme's lawyer, said the defense was "tossing out a fishing line" without any knowledge that Tohme knew anything that would help their case.

Murray's lawyers argued that Tohme is a critical witness for their defense strategy to prove that Jackson gave himself the fatal dose of anesthesia that led to his death on June 25, 2009.

Tohme had "intimate knowledge of his finances, drug use, his habits" in his final months, defense lawyer Nareg Gourjian said.

Jackson's "financial difficulties at the time is clearly relevant to our assertion that Mr. Jackson self-administered himself with propofol," Gourjian said.

While the defense argument "seems to be a lot of speculation," Pastor said he would let the subpoena of Tohme stand since he was Jackson's business manager at the time of his death. He indicated he would later consider whether to limit the subjects on which Tohme can be questioned.

The defense indicated it wanted to question Tohme about the pressure placed on Jackson in his final months to prepare for the 50 shows he was to perform in London for AEG Live starting that July.

"He (Tohme) negotiated the AEG deal and other witnesses say Mr. Jackson was very angry about this," Gourjian said.

Tohme will not cooperate with the defense by giving them an interview ahead of his testimony, he said.

The court will consider a similar motion next week by Dr. Arnold Klein.

The defense contends the Beverly Hills dermatologist gave Jackson drugs that Dr. Murray did not know about in the weeks before his death.

The Los Angeles County coroner ruled Jackson's cause of death was "acute propofol intoxication," in combination with "the contributory affects of the benzodiazepines."

The court will hold a third day of jury selection next week to build up a pool of "hardship qualified" potential jurors -- those whose families, finances and jobs could withstand a two month trial. The final jury selection process is set for May 4, with opening statements set for May 9.

Gli avvocati di Tohme hanno sostenuto precedentemente che il loro cliente non era stato regolarmente notificato nel mandato di comparizione, ma una persona a servizio del processo ha testimoniato che Tohme era nella sua abitazione il 3 marzo.
Un rivenditore di automobili usate ha inoltre testimoniato che Lunedi che era con Tohme ad un'asta di auto in quel momento.

"Sono soddisfatto c'è molta organizzazione in questo caso", ha detto il giudice del Los Angeles Superior Court, Michael Pastor, dopo aver ascoltato entrambi i testimoni.
Pastor era più interessato per la tesi, secondo cui la testimonianza di Tohme sarebbe stata pertinente nel caso di Murray.

Paul Takakjian, avvocato di Tohme, ha detto che la difesa sta "pescando fuori la linea di pesca", visto che Tohme non è a conoscenza di nulla e non sa come possa fare per aiutare il loro caso.

Gli avvocati di Murray hanno invece sostenuto che Tohme è un testimone critico per la loro strategia di difesa, potendo dimostrare che Jackson iniettò su se stesso la dose fatale di anestesia che lo portò alla morte il 25 giugno 2009.
Tohme era a "conoscenza intima delle sue finanze, il consumo di droga, le sue abitudini", negli ultimi mesi, commenta l'avvocato difensore di Murray Nareg Gourjian.
Jackson era in "serie difficoltà finanziarie in quel momento, un chiaro interesse per la nostra affermazione che il signor Jackson si è auto-somministrato il propofol", ribadisce
Gourjian.

Mentre gli argomenti della difesa "sembrano essere solo speculazioni," Pastor ha detto che avrebbe lasciato testimoniare Tohme in quanto è stato direttore commerciale di Jackson al momento della sua morte, poi avrebbe in seguito valutato se la
limitazione dei temi cui Tohme è a conoscenza possano essere messi in discussione.

La difesa ha indicato di voler mettere in discussione Tohme circa la pressione esercitata
dall'AEG su Jackson nei suoi ultimi mesi per preparare i 50 spettacoli che doveva eseguire a Londra a partire da Luglio.

"Tohme ha negoziato l'affare con l'AEG e altri testimoni dicono che il signor Jackson era molto arrabbiato per questo", ha detto Gourjian.
Tohme ha cmq detto che non collaborerà con la difesa, dando loro solo una dichiarazione prima della sua testimonianza.

Il tribunale prenderà in considerazione una proposta simile la settimana prossima anche dal dottor Arnold Klein.
La difesa sostiene che il dermatologo di Beverly Hills somministrò farmaci a Jackson di cui il dottor Murray non era a conoscenza, nelle settimane predenti alla sua morte.
Il coroner della contea di Los Angeles ha stabilito che la causa della morte di Jackson era "intossicazione acuta propofol," in combinazione con la "contributiva influenza del benzodiazepine".

Il giudice terrà un terzo giorno di selezione della giuria la prossima settimana per costituire un pool di "disagio" qualificato dei potenziali giurati - cioè quelle famiglie, cui le finanze e l'occupazione potrebbero resistere a un processo di due mesi.
Il processo di selezione della giuria finale è fissato per il 4 maggio, con apertura delle dichiarazioni per il 9 maggio.
