Prosecutor wants Conrad Murray's 'speedy trial' delayed

Los Angeles (CNN) -- A prosecutor in the involuntary manslaughter case against Dr. Conrad Murray asked the judge Thursday to delay the trial, which is set to begin in a month.
Murray, who is charged in the death of pop star Michael Jackson, invoked his right to a speedy trial within 60 days of his arraignment, but the prosecution complained the defense has not met its duty to share information about potential witnesses.
"I do not take notes when talking to a witness," defense lawyer Michael Flanigan told Los Angeles County Superior Court Judge Michael Pastor during a hearing Thursday.
Judge Pastor scolded Flanagan and his co-cousel Ed Chernoff for not providing more details to the prosecution about the testimony they expect from the 93 people listed as potential defense witnesses.
"There are sanctions, including monetary and continuances, and also including preclusion of a witness," the judge warned.
Judge Pastor appeared caught by surprise at Murray's arraignment last month when defense lawyers invoked his right to hava a trial within 60 days.
Flanagan, outside of court Thursday, said the defense will be ready when jury selection is scheduled to start on March 24.
"The defendant has a right to go to trial within 60 days," he said. "I don't think there's any obligation for him to be completely ready 30 days before he's set to go to trial, if that were the true then what would we do the last 30 days?"
Judge Pastor ordered Murray's lawyers to create written summaries of what they've been told by witnesses in interviews.
"I guess we'll have to go out and take some more statements and tell the prosecution a little buit more about where we're coming from," Flanagan said.
Judge Pastor set a hearing for Monday morning to consider the prosecution request for a delay.
The judge also delayed making a decision until next week on allowing a new lawyer to join Murray's defense team until he can determine if there is a conflict of interest.
The lawyer, Nareg Gourjian, had worked on Michael Jackson's child molestation defense.
Murray wants Gourjian to replace Joseph Low, who left the defense team earlier this month.
Gourjian's former law firm, headed by lawyer Mark Geragos, raised the possible conflict of interest because the firm represented Jackson for two years starting in 2003, when he was charged with child molestation.
Geragos, and Michael Jackson estate's lawyer, Howard Weitzman, appeared in court Thursday to discuss the matter. But Judge Pastor asked them to return next week to meet privately because it involves "very sensitive material."
Gourjian told the judge last week that he was "in no way involved" in the Jackson case because he was "a brand-new lawyer" busy working on the a murder case at the time.
Jackson died on June 25, 2009 from what the coroner ruled was an overdose of the surgical anesthetic propofol.

Los Angeles (CNN) - Il pubblico ministero per il caso di omicidio colposo contro il dottor Conrad Murray giovedì ha chiesto al giudice di ritardare il processo, che dovrebbe iniziare in un mese.
Murray, che paga per la morte della pop star Michael Jackson, ha invocato il suo diritto ad un processo veloce entro 60 giorni dalla sua contestazione, ma l'accusa si lamentava che la difesa non ha rispettato l'obbligo di condividere le informazioni sui potenziali testimoni.
"Non prendo appunti quando parlo con un testimone" ha detto l' avvocato della difesa Michael Flanagan al giudice Michael Pastor del Los Angeles County Superior Court nel corso dell' udienza di giovedì.
Il giudice Pastor ha rimproverato Flanagan e Ed Chernoff per non fornire ulteriori dettagli per l'accusa circa le testimonianze che si aspettano dalle 93 persone elencate come testimoni della difesa.
"Ci sono sanzioni, anche in campo monetario che comprendono anche la preclusione di un testimone" ha avvertito il giudice.
Il giudice Pastor era stato colto di sorpresa nella contestazione a Murray del mese scorso quando gli avvocati della difesa hanno invocato il suo diritto ad un processo entro 60 giorni.
Flanagan, al di fuori della corte giovedi, ha detto che la difesa sarà pronta quando la selezione della giuria sarà effettuata e che è prevista per il 24 marzo.
"L'imputato ha il diritto di andare in giudizio entro 60 giorni" ha detto. "Io non credo che ci sia un obbligo per lui di essere completamente pronto in 30 giorni, altrimenti cosa faremo nei restanti 30 giorni?".
Il giudice ha ordinato agli avvocati di Murray di creare una sintesi scritta di quello che è stato detto dai testimoni nelle testimonianze.
"Credo che dovremo andare a prendere alcune dichiarazioni più importanti e raccontare all'accusa un po' di più" ha detto Flanagan.
Il giudice Pastor ha fissato una udienza per lunedi mattina per valutare la richiesta di progroga delle azioni penali.
Il giudice ha anche ritardato di prendere una decisione prima della prossima settimana su un nuovo avvocato che dovrebbe unirsi al team di difesa di Murray fino a che non può determinare se vi è un conflitto di interessi.
L'avvocato, Nareg Gourjian, aveva lavorato sulla difesa di Michael Jackson per l' accusa di molestie.
Murray vuole Gourjian per sostituire Joseph Low, che ha lasciato il team di difesa all' inizio di questo mese.
L' ex studio legale di Gourjian, guidato dall' avvocato Mark Geragos, ha sollevato il conflitto di interesse in quanto lo studio rappresentò Jackson per due anni a partire dal 2003, quando è stato accusato di molestie su minori.
Geragos e l'avvocato degli esecutori di Michael Jackson, Howard Weitzman, sono apparsi in tribunale giovedi per discutere la questione, ma il giudice Pastor ha chiesto loro di tornare la settimana prossima per incontrarsi privatamente perché si tratta di "materiale molto sensibile".
Gourjian ha detto al giudice la scorsa settimana che non era "in alcun modo coinvolto" nel caso di Jackson, perché era "un avvocato nuovissimo" occupato a lavorare su un caso di omicidio, in quel momento.
Jackson è "morto" il 25 giugno 2009, da ciò che il medico legale ha stabilito è stata un'overdose di propofol, un anestetico chirurgico.
